Terms of Service

These Terms of Service (“Terms”) govern your access to and use of bevirtu.com and the VIRTÚ facial analysis service (the “Service”) operated by VIRTÚ (“VIRTÚ,” “we,” “us”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract under applicable law to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide to us is accurate.

2. The Service

VIRTÚ provides a one-time facial-analysis report and a 30-day protocol based on photos and questionnaire responses you submit. The report is reviewed by a licensed aesthetician. The report is delivered as a digital PDF, typically within 48 hours of photo upload.

The Service is not medical advice. The report is informational and based on observational analysis of your photos. It is not a diagnosis, prescription, or substitute for advice from a licensed physician, dermatologist, or other medical professional. Do not delay or disregard medical advice because of anything in your VIRTÚ report. If you have a medical concern, consult a qualified healthcare provider.

3. Pricing and payment

The current price for a VIRTÚ analysis is $39.00 USD, charged once at checkout. Payments are processed by Stripe. By submitting payment information you authorize us to charge the amount shown at checkout, including any applicable taxes. Prices may change at any time; the price shown at the time of your purchase is the price you will be charged.

4. Refund policy

We offer a 14-day money-back guarantee. If you are not satisfied with your analysis for any reason, email hello@bevirtu.com from the address associated with your account within 14 days of your report being delivered, and we will issue a full refund to the original payment method. Refunds are typically processed within 5–10 business days. The refund period begins on the date the report is delivered, not the date of purchase.

5. Photos and content you submit

When you submit photos, questionnaire responses, or other content, you grant VIRTÚ a limited, non-exclusive, royalty-free, worldwide license to use that content solely to operate the Service for you — that is, to generate, deliver, and improve your personalized analysis. We do not use your photos to train AI models; we do not publish your photos; we do not sell your photos. Our handling of your photos is described in our Privacy Policy.

You represent that you own the rights to any photo or other content you submit and that submitting it does not violate any law, third-party right, or other person's privacy.

6. Intellectual property

The Service, including the VIRTÚ name, logo, methodology, scoring rubric, written content, and the format of the analysis report, is owned by VIRTÚ and protected by copyright, trademark, and other intellectual-property laws. We grant you a personal, non-transferable, non-exclusive license to view your own analysis report and to follow the protocol it describes. You may not copy, redistribute, sell, sublicense, reverse-engineer, or use the Service or its outputs to build a competing product.

7. Acceptable use

You agree not to:

  • Submit photos or information that you do not have permission to share, or that depict anyone other than yourself.
  • Use the Service in violation of any law or regulation.
  • Interfere with, disrupt, or compromise the integrity or security of the Service.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems.
  • Use scrapers, bots, or other automated tools to access the Service without our prior written permission.
  • Resell, sublicense, or otherwise commercialize the Service or its outputs.

8. Account security

You are responsible for maintaining the security of your account, including the email address and any sign-in links sent to it. Notify us immediately if you believe your account has been compromised.

9. Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation. We do not guarantee any particular result from following the protocol in your report.

10. Limitation of liability

To the maximum extent permitted by law, in no event will VIRTÚ, its officers, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Service. Our total cumulative liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim, or $39, whichever is greater.

Some jurisdictions do not allow certain limitations on liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold VIRTÚ harmless from any claim, loss, damage, liability, or expense (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Service.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or that termination is necessary to protect us, the Service, or other users. You may stop using the Service at any time by emailing us. Sections 5–13 survive termination.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to the exclusive jurisdiction of those courts. You waive any right to participate in a class action against us.

14. Changes to these Terms

We may modify these Terms from time to time. We will post the updated Terms at this URL and update the “Effective” date at the top. For material changes we will provide reasonable notice. Continued use of the Service after a change constitutes acceptance of the new Terms.
